(hereinafter referred to as: Service Provider)
2. Scope of the GTC
These General Terms and Conditions apply to the real estate brokerage services provided by the Service Provider.
The scope of the GTC covers all agency agreements concluded between the Service Provider and the Client.
By signing the agreement or using the service, the Client accepts the provisions of these GTC.
3. Subject of the Service
The Service Provider carries out real estate brokerage activities, in particular:
- mediation of properties for sale
- sourcing potential buyers
- preparation and publication of advertisements
- organisation of property viewings
- facilitation of negotiations
- coordination of the sale and purchase process
The Service Provider does not undertake legal representation unless separately agreed in writing.
4. The Agency Agreement
The service is provided on the basis of an agency agreement.
The agency agreement shall include:
- details of the property
- the asking price
- the type of mandate (exclusive / non-exclusive)
- the amount of the commission fee
- the duration of the mandate
5. Brokerage Fee
The Service Provider shall be entitled to the brokerage fee if the sale and purchase agreement is concluded as a result of the Service Provider’s activities.
The brokerage fee amounts to 2–3% + VAT of the market value of the property (or a fixed amount as specified in the contract).
In the case of premium or high-value properties, the brokerage fee shall be determined by individual written agreement between the parties.
The fee becomes due upon the signing of the sale and purchase agreement.
6. Obligations of the Client
The Client shall:
- provide accurate information regarding the property
- allow the property to be shown
- disclose all material circumstances
- provide information regarding the legal status of the property
The Service Provider shall not be liable for damages resulting from false or inaccurate information provided by the Client.
7. Liability
The Service Provider’s activity constitutes an obligation of due care.
The Service Provider does not guarantee the successful sale of the property or the timeframe thereof.
The Service Provider shall not be liable for:
- changes in market conditions
- the buyer’s solvency
- decisions of third parties
8. Data Processing
The Service Provider processes personal data in accordance with the applicable data protection legislation.
Details of data processing are set out in the Privacy Notice.
9. Termination of the Agreement
The mandate shall terminate:
- upon expiry of the fixed term
- by mutual agreement
- by notice of termination (under the conditions specified in the agreement)
In the case of an exclusive mandate, the Client may not appoint another agent during the agreed contractual period.
10. Settlement of Disputes
The parties shall endeavour to settle any disputes amicably.
If this does not lead to a resolution, the parties agree to the exclusive jurisdiction of the competent court at the registered office of the Service Provider.
11. Final Provisions
These GTC shall enter into force on 1 January 2024.
The Service Provider reserves the right to amend these GTC. Amendments shall enter into force upon publication on the website.
